Welcome to Fort School!

These terms and conditions outline the rules and regulations for the use of Fort School‘s web application, located at https://platform.fortschool.co.ke/ and the application on Play Store.

By accessing this website we assume you accept these terms and conditions. Do not continue to use Fort School if you do not agree to take all of the terms and conditions stated on this page.

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: ‘Client‘, ‘You‘ and ‘Your‘ refers to you, the person log on this website and compliant to the Company‘s terms and conditions . ‘The Company‘, ‘Ourselves‘, ‘We‘, ‘Our‘ and ‘Us‘, refers to our Company. ‘Party‘, ‘Parties‘, or ‘Us‘, refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client‘s needs in respect of provision of the Company‘s stated services, in accordance with and subject to, prevailing law of Kenya. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Our Service

Student

Our service allows students to watch, discover and share educative video content published by teachers signed up on our platform. The service also involves attending to virtual classes scheduled, attempt automatically marked quizzes, ask questions and get answers from teachers as well as viewing other asked questions.

Teacher

Our service allows you to publish video content for our learners, schedule classes and respond to student’s questions. You can also invite students to join your invites community.

Institution

Our service allows institutions to set up virtual schools where they will invite students and teachers, publish private content and virtual classes, manage expired subscriptions for your learners.

Who may use our service?

Age Restrictions

You must be above 13 years to be able to use the services in your respective categories. However, anyone below this age can use the service with the help of their parents/guardian.

Permission from Parent

If you are less than 18 years, you must acquire permission from your parent/guardian to use our services.

Your Information

Our Privacy Policy explains how we process and handle your personal data and protect your privacy when you use our service.

Permissions and Restrictions

You may access and use the Service as made available to you, as long as you comply with this Agreement and the law. You may view or listen to Content for your personal, non-commercial use.

The following restrictions apply to the use of our service. You are not allowed to:

a) Reproduce, download, distribute, sell, license, any part of the service or any video content except:

i. If you own the intellectual property of the content.
ii. With prior written permission from Fort School

b) Access the services using any automated means such as bots or robots except with the case of:

i. Permission by the law.
ii. Fort School’s prior permission

c) Collect or use any information that might identify a person unless permitted by that person or with prior permission from Fort School.

d) Use our services to unsolicited promotional content or unwanted spams.

e) Cause or encourage any inaccurate measurements of genuine user engagement with the Service, including by paying people or providing them with incentives to increase a video’s views, likes, or dislikes, or to increase a channel’s subscribers, or otherwise manipulate metrics

f) Use the service to:

i. Sell any ads, promotions or sponsorships unless when permitted by Fort School

Develop, Improve and Update our Services

Fort School is constantly improving the user experience on our platforms and this includes modifying part or all services, adding new services or removing other services. In event of modifications which affect the terms on this document and which would require modification of this agreement, we will always notify the users prior and after updating our terms and conditions except for urgent situations such as addressing a security issue, preventing abuse or responding to legal obligation.

Content and Conduct

For teachers and Institutions, you may upload video or any other form of content to the Fort School platform under two categories: private and public as described hereunder. Fort School is constantly reviewing every upload made to protect our users, and in the event of any violation we may pull the content down or permanently ban the user from the platform based on the scenario.

Private

Private content is only accessible to the audience you choose either by inviting them or sharing the access code with them

Public

Public content is publicly available to our users and will be retrieved by our search algorithm. If you don’t want your content to be retrieved by these algorithms, you can flag it as private.

The content you choose to upload must meet the requirements stated below:

a) You must own full intellectual rights for the content you choose to upload
b) The content must be strictly educative, and strictly no use of offensive language, and must be relevant to the target audience selected.

Duration of License

The duration of this license is valid up until the removal of the content from our platforms through:

• Voluntary deletion by the author
• Requirement by the law to remove the content
• Deletion by Fort School in case of any violations stated above.

Right to Monetize

You grant Fort School the right to monetize any uploaded content including charging users a fee for access. This agreement does not entitle you to any payment. However, you might be entitled to get payment from any other agreement with the company for example; pay per views.

Deletion of your Content

You may delete your content from our platform any time. You must delete the content of you no longer have the rights required by these terms.

Deletion of Content by Fort School

We may remove your content temporarily or permanently if we reasonably believe your content:

• Is in breach of this Agreement
• May cause harm to our users
• Would compromise an ongoing investigation

We will notify you when such decision to pull down your content is made.

Account Termination & Suspension

Voluntary Termination

Fort School will terminate or suspend your account if:

• There have been a breach to this agreement.
• We are required to comply with the law.
• We reasonably believe your conduct creates harm to other Fort School users.

We will notify you of any suspension or termination of your account unless doing so would:

• Violate the laws from a legal authority
• Compromise an investigation

Limitation of liability

Fort school is not responsible, to the extent permitted by law for:

Losses or harm that were not caused by Fort School or its affiliates

Content submitted by any user, or defamatory, offensive or illegal conduct of any user.

We employ the use of cookies. By accessing Fort School, you agreed to use cookies in agreement with the Fort School‘s Privacy Policy. Most interactive websites use cookies to let us retrieve the user‘s details for each visit. Cookies are used by our website to enable the functionality of certain areas to make it easier for people visiting our website.

Disclaimer

To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our website and the use of this website. Nothing in this disclaimer will:

• limit or exclude our or your liability for death or personal injury;
• limit or exclude our or your liability for fraud or fraudulent misrepresentation;
• limit any of our or your liabilities in any way that is not permitted under applicable law; or
• Exclude any of our or your liabilities that may not be excluded under applicable law.
